1. Acceptance of terms
By creating an account, activating a business or using Z·Apply, the user declares that they have read, understood and agree to these Terms of Service. If you do not agree with these conditions, you must not use the service.
2. What Z·Apply is
Z·Apply is a SaaS platform for customer service over WhatsApp and Instagram — with support for other messaging channels — featuring artificial intelligence, CRM, unified inbox, sales pipeline, integrated scheduling and external integrations. The service is provided as is, with continuous evolution, operational improvements and adjustments consistent with the product's development.
3. Registration and account
- The user must provide truthful, current and complete information.
- Each business has an isolated environment within the platform.
- The account holder, especially the administrator, is answerable for actions taken by the team members linked to the business.
- The user is responsible for keeping their credentials protected and not sharing them improperly.
4. Activation, contracting and access
- Access to Z·Apply depends on commercial activation and on the configuration contracted for the business.
- The capabilities enabled may vary according to the operational configuration associated with the account.
- Z·Apply does not process payments between the customer company and its end customers.
- Commercial conditions of the platform itself, where they exist, are formalized through a proposal, order, contract or equivalent instrument, outside this public page.
- Z·Apply may adjust capabilities, naming and the composition of its offering, with reasonable prior notice whenever this affects contracted usage.
5. Acceptable use
The user agrees to:
- Use the service only for legitimate business purposes.
- Not send spam, unsolicited bulk messages or illegal content through WhatsApp, Instagram or any other channel connected to the platform.
- Respect the policies of the connected channels, including Meta's Platform Terms and the messaging rules of WhatsApp and Instagram.
- Not attempt to access data belonging to other businesses.
- Not reverse engineer, scrape or abuse the APIs.
- Not use the service for illegal or fraudulent activities, or activities that violate third-party rights.
6. External integrations
- Z·Apply may integrate with third-party services such as WhatsApp, Instagram (Meta), Telegram, Mercado Livre, Google Calendar and other enabled connectors.
- How these integrations work depends on the availability, technical rules and policies of those third-party services.
- Z·Apply is not liable for unavailability, API changes, usage limits or policy changes on the part of those third parties.
- The user is responsible for keeping integrations correctly configured, authorized and valid.
Connected Instagram and Meta accounts
- The connected Instagram account belongs to the user. By connecting it, they authorize Z·Apply to read and reply, on their behalf, to the direct messages that account receives — and nothing beyond that.
- The user declares that they own the account or are authorized by whoever does, and remains responsible for complying with Meta's Platform Terms and Community Standards in the content they send through the platform.
- Meta may, at its own discretion, limit, suspend or terminate access for the connected account or the application. That is outside Z·Apply's control and creates no liability on our part.
- The user may disconnect the integration at any time through the dashboard, or by removing Z·Apply in their Instagram settings. How the data received from Meta is handled is described in our Privacy Policy, and deletion at User Data Deletion.
7. AI and automated service
- Z·Apply uses artificial intelligence in the automated service flows of connected channels, including WhatsApp and Instagram.
- To generate replies, message content and the contact's context are processed by a contracted language model provider, as described in our Privacy Policy. That content is not used to train models.
- AI responses depend on the knowledge base, settings and operational data available.
- Z·Apply does not guarantee that every automated response will be perfect or suitable for every situation.
- The user is responsible for reviewing the content, settings and knowledge bases used by the AI, and for not configuring the agent to send unsolicited messages or content that violates the policies of the connected channels.
- Handoff to a human agent should be used in scenarios that require human judgement, supervision or validation.
8. Intellectual property
- The Z·Apply brand, code, interface, documentation and original elements belong to their rightful owners.
- Data entered by the user — conversations, leads, contacts and operational information — remains the responsibility and property of the using business, where applicable.
- Z·Apply receives a limited licence to process that data exclusively to provide the service.
9. Availability and SLA
- Z·Apply strives for continuous availability but does not guarantee 100% uptime.
- Scheduled maintenance will be announced in advance whenever possible.
- Temporary outages may occur for technical or operational reasons, or because of integrated third parties.
10. Limitation of liability
- Z·Apply is not liable for lost sales, indirect damages, loss of profits or losses arising from the use of, or inability to use, the service.
- To the maximum extent permitted by law, the operator's total liability, where financial consideration exists, is limited to the amount actually paid by the customer in the 12 months preceding the event giving rise to the claim.
11. Cancellation
- The user may request account cancellation at any time through the dashboard, where available, or by email.
- Termination of access will observe the conditions of the current contract and the applicable operational validations.
- After cancellation, data may be retained for up to 90 days, as described in the Privacy Policy, and is subsequently deleted.
- Z·Apply may suspend or terminate accounts that violate these terms, operational policies or applicable legal obligations.
12. Changes to these terms
Z·Apply may update these terms at any time. Relevant changes may be communicated by email, notice in the dashboard or another appropriate channel. Continued use of the service after a change takes effect constitutes acceptance of the updated version.
13. Governing law and venue
- These terms are governed by Brazilian law.
- The courts of the operator's registered seat are elected as venue, except where the law provides otherwise.
- The parties will seek to resolve disputes amicably before resorting to litigation, whenever possible.
